Leniency to Be Sought for 12 Map Ta Phut Projects

The Office of the Attorney General is planning to seek the administrative court's leniency for 12 Map Ta Phut projects this week as a part of the industry ministry's effort to help those effected by the injunction.

Industry Minister Charnchai Chairunreong revealed the panel in charge of assisting investment projects suspended by the Administrative Court's ruling has completed its draft of assistance measures for 49 of the 64 suspended projects.

The panel has come up with four plans.


First, there are currently 10 projects which do not need an environmental impact assessment, or EIA, but must make known their measures to lessen the environmental impact during the construction of their facilities.

The panel has already submitted documents to the Office of Natural Resources and Environmental Policy and Planning on behalf of seven out of the 10 projects.

Two are still seeking further advices from the same body and another has been put on hold.

The second is to help four projects which can prove they have received permission prior to the promulgation of the current Constitution.

The panel has already sent their evidence and notification of their rights to the Industrial Estate Authority of Thailand.

The third is to help nine projects not prone to have environmental effects from their operation.

The panel will ask the court for more leniency for these projects the same way it did with the first 11 projects which were granted approval to proceed.

The last is to help 16 projects seek the court's leniency to proceed with the construction of their facilities and machine tests.

The panel will ask the Office of the Attorney General to file petition with the court on the investors behalf to seek leniency for 12 projects while four projects will need to be scrutinized further.

The OAG, meanwhile, disclosed the petition for the 12 projects will be submitted between February 12 and 15.
